Important Notice to Users
These Terms and Conditions govern your use of the TAG Legal website at www.taglegal.com.au (the Website). Please read them carefully before using the Website.
TAG Legal Pty Ltd (TAG Legal) is an Incorporated Legal Practice (ILP) regulated by the Law Society of New South Wales under the Legal Profession Uniform Law (NSW) 2014 (LPUL) and registered with the Australian Securities and Investments Commission (ASIC) under the Corporations Act 2001 (Cth). These Terms and Conditions apply to the Website only. They are not a retainer, costs agreement, or engagement letter. A formal retainer and costs disclosure will be provided separately before any legal services are delivered.
By accessing or using the Website, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Website.
1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
ACL means the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
ASIC means the Australian Securities and Investments Commission.
Costs Disclosure means written disclosure of legal costs as required by Part 4.3 of the LPUL, provided to a client before or as soon as practicable after a retainer is formed.
DVA means the Australian Department of Veterans’ Affairs (also known as the Department of Veterans Affairs).
ILP means an Incorporated Legal Practice as defined in section 6 of the LPUL.
Law Society means the Law Society of New South Wales.
Legal Services means legal advice, representation, TPD claims assistance, and DVA entitlements advice provided under a formal retainer by TAG Legal’s principal solicitor.
LPUL means the Legal Profession Uniform Law (NSW) 2014 as in force from time to time.
Non-Legal Advocacy Services means DVA claims advocacy and related administrative support for physical and mental health claims that do not constitute legal practice and are delivered under the TAG advocacy framework.
Personal Information has the meaning given in the Privacy Act 1988 (Cth) and includes contact, health, and service-relevant information provided by a user.
Principal Solicitor means Gillian Collins, principal solicitor of TAG Legal, holding a current practising certificate issued by the Law Society of NSW.
Retainer means the written agreement between TAG Legal and a client that engages TAG Legal to provide Legal Services on specified terms.
TAG Legal, we, us or our means TAG Legal Pty Ltd ACN [INSERT ACN] ABN 44 695 235 146.
TPD means Total and Permanent Disability, referring to insurance claims under superannuation policies.
User, you or your means any person who accesses or uses the Website.
Website means the TAG Legal website located at www.taglegal.com.au and all associated pages.
2. About TAG Legal
2.1 TAG Legal Pty Ltd is an Incorporated Legal Practice incorporated in New South Wales. The practice provides two distinct streams of service:
(a) Legal Services: legal advice, TPD claims assistance, and advice on DVA entitlements, delivered under a formal retainer by the Principal Solicitor; and
(b) Non-Legal Advocacy Services: DVA claims and administrative support for physical and mental health claims that do not constitute legal practice.
2.2 TAG Legal has given notice to the Law Society of NSW of its intention to engage in legal practice as required by section 104 of the LPUL.
2.3 The Principal Solicitor holds a current practising certificate issued by the Law Society of NSW. TAG Legal is an ILP Member of the Law Society of NSW.
2.4 TAG Legal’s occupational liability is limited by a scheme approved under Professional Standards Legislation.
3. Nature of Website Content
3.1 The Website contains general information about TAG Legal’s services, team, and areas of practice. It is provided for informational purposes only.
3.2 Nothing on the Website constitutes legal advice, an opinion on the merits of a claim, or a representation that any particular outcome will be achieved. Legal advice is only given under a formal retainer.
3.3 Information on the Website about DVA entitlements, TPD claims, or veterans’ rights is general in nature and may not apply to your specific circumstances. You should contact us directly to discuss your individual situation.
3.4 TAG Legal does not guarantee that information on the Website is current, complete, or error-free. Laws, regulations, DVA policies, and eligibility criteria change frequently. You should not rely solely on Website content when making decisions about your rights or entitlements.
3.5 Any testimonials or case outcomes mentioned on the Website are illustrative only. Past results do not guarantee future outcomes.
4. No Solicitor-Client Relationship
4.1 Use of the Website, completion of a contact form, or submission of an online enquiry does not create a solicitor-client relationship between you and TAG Legal.
4.2 A solicitor-client relationship is only formed when:
4.2.1 TAG Legal has completed its conflict-of-interest check and intake triage process;
4.2.2 a formal written Retainer has been signed; and
4.2.3 Costs Disclosure has been provided and acknowledged as required by the LPUL.
4.3 Until a Retainer is in place, TAG Legal is not your lawyer and owes you no professional duties of confidentiality, advice, or loyalty beyond general ethical obligations.
5. Legal Services and Costs Disclosure
5.1 Before TAG Legal provides Legal Services, the Principal Solicitor will provide you with a written Costs Disclosure and Retainer as required by the LPUL. This will include:
5.1.1 the basis on which legal costs will be calculated;
5.1.2 a reasonable estimate of total legal costs (including professional fees, disbursements, and GST);
5.1.3 your right to receive a bill and to request an itemised bill;
5.1.4 your right to seek costs assessment if you dispute a bill; and
5.1.5 your right to seek assistance from the Office of the Legal Services Commissioner (NSW) in the event of a costs dispute.
5.2 TAG Legal’s fees must be fair and reasonable in all circumstances, as required by section 171 of the LPUL.
5.3 If you are a client receiving Non-Legal Advocacy Services only, separate fee arrangements apply. These are not governed by the LPUL but will be clearly communicated before services commence.
5.4 Where a matter involves both Legal Services and Non-Legal Advocacy Services, the fees and scope of each stream will be clearly separated in your engagement documents.
6. Dual-Stream Services — Legal and Non-Legal Work
6.1 TAG Legal operates two distinct service streams. Legal Services are performed by or under the direct supervision of the Principal Solicitor. Non-Legal Advocacy Services are performed by qualified advocacy staff and do not constitute legal practice.
6.2 When a client requires both streams simultaneously, TAG Legal will:
6.2.1 clearly identify which activities fall within each stream;
6.2.2 ensure separate records are maintained for each stream; and
6.2.3 manage any actual or potential conflicts between streams in accordance with the LPUL and TAG Legal’s internal policies.
6.3 Where a matter that begins as a Non-Legal Advocacy Service develops a legal dimension — for example, where legal advice becomes necessary — TAG Legal will notify you promptly and advise whether a separate Retainer for Legal Services is required.
7. Acceptable Use of the Website
7.1 You agree to use the Website only for its intended purpose — to learn about TAG Legal’s services and to make enquiries.
7.2 You must not use the Website to:
7.2.1 engage in any unlawful, fraudulent, or harmful activity;
7.2.2 upload, transmit, or distribute malicious software, viruses, or harmful code;
7.2.3 scrape, harvest, or systematically collect data from the Website without our written consent;
7.2.4 impersonate any person or entity or misrepresent your identity;
7.2.5 interfere with or disrupt the Website’s operation or security; or
7.2.6 attempt to gain unauthorised access to any part of the Website or its related systems.
7.3 Any breach of this clause may result in TAG Legal taking appropriate action, including reporting conduct to relevant authorities.
8. Intellectual Property
8.1 All content on the Website — including text, graphics, logos, images, and the “Veterans Rights Matter” trademark — is the property of TAG Legal or its licensors and is protected by Australian intellectual property laws.
8.2 You may access and print Website content for your personal, non-commercial use only. You must not reproduce, republish, transmit, or commercially exploit any Website content without TAG Legal’s prior written consent.
9. Privacy and Personal Information
9.1 TAG Legal collects and handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). As a legal practice, TAG Legal also observes its obligations regarding client confidentiality under the LPUL and the Australian Solicitors’ Conduct Rules.
9.2 Personal information collected through the Website (including via contact forms or enquiry submissions) is used to:
9.2.1 respond to your enquiry;
9.2.2 conduct intake and conflict-of-interest checks; and
9.2.3 assess your suitability for TAG Legal’s services.
9.3 Health information and other sensitive information you provide will be treated with the highest level of care and will only be used or disclosed as permitted under the Privacy Act and applicable professional obligations.
9.4 TAG Legal’s Privacy Policy sets out in full how we collect, use, disclose, and store personal information and is available on the Website. By using the Website, you consent to the handling of your personal information in accordance with that Policy.
9.5 TAG Legal will not disclose your personal information to third parties for marketing purposes without your explicit consent.
10. Communications and Marketing
10.1 By submitting an enquiry through the Website, you consent to TAG Legal contacting you to respond to that enquiry.
10.2 TAG Legal may from time to time send service-related communications to your nominated contact details. These are necessary communications relating to your matter or enquiry.
10.3 TAG Legal will only send marketing communications where you have provided express consent, in accordance with the Spam Act 2003 (Cth). You may withdraw consent at any time by contacting us using the details below.
10.4 We do not display advertising on the Website, and we do not allow third parties to use the Website to promote their products or services.
11. Third-Party Content and Links
11.1 The Website may contain links to external websites or references to third-party content. These are provided for convenience only and do not constitute an endorsement or recommendation by TAG Legal of any third party, their products, or their services.
11.2 TAG Legal takes no responsibility for the accuracy, currency, or suitability of third-party content. Any use of third-party content is at your own risk.
11.3 TAG Legal does not warrant that linked websites are free from malicious software or that their content complies with applicable laws.
12. Disclaimers and Limitation of Liability
12.1 To the maximum extent permitted by law, the Website is provided “as is” without warranties of any kind, express or implied, including warranties of fitness for a particular purpose, accuracy, or availability.
12.2 TAG Legal does not warrant that the Website will be uninterrupted or error-free or that any defects will be corrected.
12.3 Nothing in these Terms and Conditions excludes any guarantee, warranty, or right that cannot be excluded under the ACL, including any consumer guarantees. If the ACL applies, TAG Legal’s liability is limited, at TAG Legal’s election, to resupply of the relevant services or payment of the cost of having the services resupplied.
12.4 To the extent permitted by law, TAG Legal excludes all liability for any loss or damage — including direct, indirect, consequential, or special loss — arising from your use of, or reliance on, the Website or its content.
12.5 These limitations apply whether the liability arises in contract, tort (including negligence), statute, or otherwise.
13. Professional Standards and Complaints
13.1 TAG Legal and the Principal Solicitor are subject to the professional conduct obligations set out in the LPUL and the Australian Solicitors’ Conduct Rules 2015. The Law Society of NSW and the Office of the Legal Services Commissioner (NSW) have oversight of the practice.
13.2 If you have a complaint about TAG Legal’s services, you may contact TAG Legal directly in the first instance at the details below. If the matter is not resolved to your satisfaction, you may lodge a complaint with the Office of the Legal Services Commissioner (NSW) at www.olsc.nsw.gov.au.
13.3 Complaints about ASIC-regulated conduct may be lodged with ASIC at www.asic.gov.au.
14. Anti-Money Laundering and Financial Compliance
14.1 As a legal practice, TAG Legal is a reporting entity for the purposes of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (AML/CTF Act) in respect of designated services it provides.
14.2 Where required by the AML/CTF Act, TAG Legal will verify the identity of clients before providing designated services and may be required by law to report certain transactions or suspicious matters to AUSTRAC.
14.3 Any refunds of fees will only be made via the same payment method through which the original payment was received, and will be processed in Australian dollars. This policy supports TAG Legal’s AML/CTF compliance obligations.
15. Changes to These Terms and Conditions
15.1 TAG Legal may update these Terms and Conditions at any time. Changes will take effect when the updated Terms and Conditions are posted on the Website. The effective date at the top of this document will be updated accordingly.
15.2 Your continued use of the Website after any changes are posted constitutes acceptance of the updated Terms and Conditions. We encourage you to review this page periodically.
16. General
16.1 These Terms and Conditions are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales in respect of any dispute arising out of or in connection with these Terms and Conditions.
16.2 If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
16.3 TAG Legal’s failure to enforce any right under these Terms and Conditions does not constitute a waiver of that right.
16.4 You may not assign, transfer, or sub-contract your rights or obligations under these Terms and Conditions without TAG Legal’s written consent.
16.5 TAG Legal may assign its rights and obligations without notice to you in connection with a restructure, merger, or transfer of the practice, subject to applicable professional conduct rules.
